Girz.ai Terms of Service

Welcome to Girz.ai! These Terms of Service ("Terms") govern your use of the Girz.ai website, platform, and services (collectively, the "Service"), operated by AIRT LLC ("Girz.ai," "we," "us," or "our").

Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. Description of the Service

Girz.ai provides a platform for female content creators ("Creators") to monetize their influence through a personalized, AI-powered digital persona ("AI Persona"). Users of the service ("Fans") can interact with these AI Personas through chat and purchase AI-generated images and other digital content ("AI Content"). The Service is designed to provide a passive income stream for Creators and a unique, engaging experience for Fans.

2. User Accounts

Eligibility : You must be at least 18 years old and of the legal age of majority in your jurisdiction to create an account and use the Service.

Account Security : You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Terms for Creators

Onboarding : To become a Creator, you will work with the Girz.ai team in a guided setup process. You will provide us with the necessary information, photos, and guidelines (the "Brief") to create an AI Persona that accurately reflects your brand and personality.

Content Control & Safety : You retain absolute control over your AI Persona. This includes :

• - Defining a list of banned words and topics the AI must not discuss.
• - Approving or disabling specific categories of AI Content that can be generated (e.g., suggestive, artistic nudes, explicit).
• - Girz.ai will implement these rules, and your AI Persona will not generate content or engage in conversations that violate your predefined boundaries.

Creator Responsibilities : You represent and warrant that you have all necessary rights to the materials you provide in your Brief and that they do not infringe on any third-party rights.

4. Terms for Fans

Virtual Tokens : The Service uses a system of virtual credits or "Tokens" that can be purchased to interact with AI Personas and unlock AI Content.

No Monetary Value : Tokens are not real currency and have no monetary value outside of the Service. They cannot be redeemed for cash or transferred to other users.

All Purchases Final : All purchases of Tokens are final and non-refundable, except as required by applicable law.

Subscriptions : We may offer subscription plans that provide access to certain features. Terms for subscriptions will be presented at the time of purchase.

5. AI-Generated Content

Nature of Content : You acknowledge that all images, text, and media generated by the AI Personas are synthetic and created by an artificial intelligence model. They are not real photographs or statements from the human Creator.

Intellectual Property License : When a Fan unlocks a piece of AI Content, Girz.ai grants the Fan a limited, personal, non-transferable, non-sublicensable, worldwide license to use and display that AI Content for non-commercial purposes only. You may not sell, reproduce, distribute, or create derivative works from the AI Content.

No Guarantees : While we strive for high-quality and accurate AI replication, we do not guarantee that AI Content will be free of errors, artifacts, or imperfections.

6. User Conduct and Prohibited Activities

You agree not to use the Service to :

• - Engage in any form of harassment, abuse, or threatening behavior.
• - Request, generate, or distribute illegal content, including but not limited to content depicting child abuse.
• - Impersonate any person or entity.
• - Attempt to reverse-engineer, decompile, or otherwise access the source code of the Service or the AI models.
• - Use the Service for any commercial purpose not explicitly authorized by these Terms.
• - Attempt to trick, manipulate, or force an AI Persona to violate its predefined safety rules.

Violation of these rules may result in immediate and permanent termination of your account without a refund.

7. Intellectual Property

Our IP : The Girz.ai platform, logo, branding, and underlying technology are the exclusive property of AIRT LLC and its licensors.

Creator IP : Creators retain all ownership rights to their name, likeness, brand, and the source materials provided in their Brief.

8. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for any violation of these Terms.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, GIRZ.AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF.

IN NO EVENT SHALL GIRZ.AI, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER.

10. Changes to Terms

We may modify these Terms at any time. We will provide notice of significant changes, such as by posting an announcement on the Service or sending an email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

11. Governing Law
